RESTRUCTURINGS AND REDUNDANCY

Employers are entitled to restructure their businesses. They need to have a genuine reason for any restructuring (for example, decrease in profitability or no need for the relevant position or positions). They need to follow a fair process before deciding on any positions to be disestablished and then any redundancies, and they need to act in good faith.

We find sometimes there is confusion between disestablishment of a position and an employee being made redundant. One does not always follow the other. An employer needs to first look at its current structure and decide if it needs to disestablish any positions. Once it does that, and it knows what its new structure will be, it may then need to make some employees redundant.

We can provide employers and employees with advice on how to conduct a restructuring, consultation with potentially affected employees, what could be a genuine business reason, the correct process to follow for a restructuring, redeployment, and good faith obligations.
