Privacy is an important part of employment law and we have many years’ experience in advising on all aspects of privacy law.

Under the Privacy Act 2020 employees are entitled to make requests for their personal information. The Act defines when and how employers must respond and sets out the grounds for withholding information.

An area that often requires specialist advice is an employee’s entitlement to what is called “evaluative material”.  This is material such as pre-employment reference checks.

We are also able to provide advice on how to make a complaint to the Office of the Privacy Commissioner and on how to respond to/defend such a complaint. 

Another area that requires careful handling is what to do if there is a suspected or actual privacy breach.  There are strict requirements in the Privacy Act 2020 for how to deal with these situations and we can assist with this.

Business owners and managers need to ensure they have procedures and policies that address cross-boundary issues and storage of information overseas and in the cloud.
